Policy on Access to Public Records

  1. Access to public records is governed by the Indiana Code (IC 5-14-3-4 version a), and the library adheres to all of its provisions.
  2. Information made available at regular board meetings will be readily available to the public.
  3. Pursuant to IC 5-14-3-4(b), the following public records are excepted from the disclosure requirements:
    1. Personnel files of employees and files of applicants for employment, except for:
      1. The name, compensation, job title, business address, business telephone number, job descriptions, education and training background, previous work experience, or dates of first and last employment of present or former officers or employees of the public agency.
      2. Information relating to the status of any formal charges against the employee; and
      3. Information concerning disciplinary actions in which final action has been taken and that resulted in the employee being disciplined or discharged.
    2. Administrative or technical information that would jeopardize a record keeping or security system.
    3. Computer programs, computer codes, computer filing systems, and other software that are owned by the public agency or entrusted to it and portions of electronic maps entrusted to a public agency by a utility.
    4. Records specifically prepared for discussion or developed during discussion in an executive session under IC 5-14-1.5-6.1.
    5. The identity of a donor of a gift made to a public agency if the donor requires nondisclosure of his identity as a condition of making the gift; or after the gift is made, the donor, or the donor's family, request nondisclosure.
    6. Library or archival records.
      1. Which can be used to identify any library patron; or
      2. Deposited with, or acquired by, a library upon a condition that the records be disclosed only: (1) to qualified researchers; (2) after the passing of a period of years that is specified in the documents under which the deposit or acquisition is made; or (3) after the death of persons specified at the time of the acquisition or deposit.
    7. Names and addresses of employees may not be disclosed by the political subdivision to commercial entities for commercial purposes and may not be used by commercial entities for commercial purposes. [IC 5-14-3-14(c)]
    8. Other information not excepted under IC 5-14-3 will be available within 48 hours of receipt of a specific request made in writing to the library CEO.
